A BILL to amend article three, chapter twenty-nine of the code
of West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
eleven, relating to electrical inspections; criminal
penalties.
Be it enacted by the Legislature of West Virginia:
That article three, chapter twenty-nine of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
eleven, to read as follows:
ARTICLE 3B. SUPERVISION OF ELECTRICIANS.
§29-3B-11. Electrical installations and inspections; criminal
penalties.
(a) All electrical installations, which involved a new
service or change of service shall have an electrical inspection
performed by a certified electrical inspector before connection
to a utility supplier.
(b) All electrical inspectors shall be certified by the
state fire marshall using national recognized standards and must
possess a master's electrician license.
(c) The state fire marshall shall promulgate rules
implementing this article and such rules shall also include the
fees to be established for inspections and certification for
inspectors.
(d) Any person who violates any provision of this article is
guilty of a misdemeanor, and, upon conviction thereof, shall be
fined not more than one hundred dollars or imprisoned in a county
or regional jail not more than ninety days, or both fined and
imprisoned.
(e) Funds received in implementing this article shall be
placed in a revolving fund to provide continuation of the program.
NOTE: The purpose of this bill is to require electrical
inspections and approval before connection to a utility supplier.
